Gifting a Property in Singapore: ABSD, BSD, and CPF Implications

Transferring a property to a family member at nil or nominal consideration is not stamp-duty-free. IRAS treats the gift as a transaction at market value, triggering BSD and potentially ABSD. Agents asked to facilitate a gift transfer must understand the full tax cost.

What Is a Property Gift Transfer?

A property gift transfer is a legal transfer of ownership from a donor (current owner) to a recipient (donee) at nil or nominal consideration — typically expressed as "for natural love and affection" in the transfer instrument. Common scenarios:

  • Parent transferring a property to an adult child
  • Spouse transferring their share of a jointly held property to the other spouse
  • Sibling transferring a property inherited as a co-owner

The parties may believe a gift transfer avoids stamp duty because no money changes hands. This is incorrect. IRAS assesses stamp duty on the market value of the property at the date of transfer, not on the consideration paid.

BSD on Gift Transfers

Buyer's Stamp Duty (BSD) applies to all property acquisitions, including gift transfers. The donee (recipient) is the "buyer" for BSD purposes. BSD is assessed on the higher of the consideration paid or the market value at the date of the instrument of transfer. Since a gift has nil consideration, BSD is computed on the full market value.

BSD rates (as at April 2026):

  • First $180,000: 1%
  • Next $180,000: 2%
  • Next $640,000: 3%
  • Next $500,000: 4%
  • Next $1,500,000: 5%
  • Amount above $3,000,000: 6%

ABSD on Gift Transfers

ABSD applies to the donee based on the donee's property count and citizenship status at the date of the gift instrument, exactly as it would for a purchase. If the donee already owns one residential property and is a Singapore Citizen, the gift transfer will attract 20% ABSD on the market value of the gifted property.

There is no ABSD exemption for family gift transfers. The relationship between donor and donee (parent-child, spouse-spouse) does not reduce or waive ABSD.

CPF Implications for the Donor

If the donor used CPF funds to purchase or finance the property, those CPF withdrawals (principal plus accrued interest at 2.5% per annum) must be refunded to the donor's CPF OA upon transfer — even if the transfer is a gift at nil consideration.

The CPF refund obligation does not disappear simply because no money changes hands. If the property is a gift, the donor must fund the CPF refund from their own cash resources (since there are no sale proceeds to draw from). This can make gifting a CPF-financed property significantly more cash-intensive than it appears.

HDB-Specific Rules on Gift Transfers

HDB flats have additional restrictions on ownership transfer:

  • MOP must be fulfilled: HDB flats cannot be transferred during the Minimum Occupation Period. The MOP must be completed from flat collection date before any ownership change.
  • HDB approval required: All ownership changes for HDB flats require HDB's prior written approval. HDB will assess whether the proposed new owner meets HDB eligibility criteria (citizenship, family nucleus, income ceiling if applicable).
  • Eligible occupier becomes owner: An eligible occupier listed on the flat can be added as an owner, but must meet all HDB ownership eligibility requirements.

Alternatives to Gift Transfers

Given the stamp duty cost, some families consider alternatives:

  • Sale at market value: The property is sold to the family member at full market value. BSD applies at the same rates, ABSD if applicable — but the donor receives proceeds to fund the CPF refund and the donee pays BSD/ABSD from the purchase price they paid.
  • Decoupling (for spouses): One spouse transfers their share to the other so one owner becomes sole owner. BSD on the share transferred at market value applies — but this is a partial transfer, so the stamp duty is on the share value, not the full property.
  • Will: Deferring the transfer to inheritance avoids stamp duty during the donor's lifetime. The recipient inherits free of ABSD and BSD on the testamentary transfer (stamp duty treatment on inheritance differs from a gift).

Q: Is ABSD waived for gifts between spouses?

A: No. ABSD applies to gift transfers between spouses on the same basis as any other transfer. There is a separate ABSD remission for married SC couples purchasing a property together as their first jointly owned property — but this is a specific remission for a purchase, not a general exemption for spousal transfers.

Q: Does the donor pay any stamp duty on a gift transfer?

A: The donor (transferor) does not pay BSD or ABSD — these are buyer-side duties. The donor may be liable for Seller's Stamp Duty (SSD) if the property is transferred within 3 years of the donor's acquisition, as SSD applies to disposals including gifts within the holding period.

Q: Can the donee use CPF to pay BSD and ABSD on a gift transfer?

A: No. BSD and ABSD must be paid in cash. CPF can only be used toward the purchase price (down payment and mortgage instalments) — not for stamp duties. This means the donee needs cash to fund BSD and any ABSD arising from the gift.
