HDB Subletting Rules Singapore 2026: Room Rental vs Whole Flat Subletting — What Agents Must Know

HDB flat owners can sublet bedrooms at any time after key collection, but subletting the entire flat is only allowed after the Minimum Occupation Period (MOP). Both scenarios have specific approval, occupancy, and tenant eligibility requirements. CEA agents assisting HDB landlords must understand these rules to avoid facilitating non-compliant rental arrangements.

Overview: Room Rental vs Whole-Flat Subletting

HDB distinguishes between two types of rental arrangements for flat owners:

  • Room rental (subletting of bedrooms): Renting out one or more bedrooms within the flat while the owner continues to occupy the flat. This is permitted at any time — there is no MOP requirement for room rental, but the owner must register the rental with HDB.
  • Whole-flat subletting: Renting out the entire flat without the owner residing in it. This is only permitted after the flat has fulfilled the applicable Minimum Occupation Period (MOP) — typically 5 years from key collection. HDB approval is required before the subletting commences.

Room Rental Rules

Room rental (subletting of bedrooms) is available to all HDB flat owners from the date of key collection, including owners still within the MOP. Key requirements:

Owner Must Remain in Residence

The flat owner (or at least one listed owner in the case of joint ownership) must continue to physically reside in the flat throughout the rental period. Room rental does not allow the owner to move out — that would constitute whole-flat subletting, which requires MOP completion and HDB approval.

Tenant Eligibility

HDB prescribes which tenant nationalities are eligible to rent HDB bedrooms:

  • Singapore Citizens and Permanent Residents — permitted
  • Non-citizens (foreigners) holding certain passes — permitted subject to conditions. Eligible passes include Employment Pass, S Pass, Work Permit (non-Malaysian), student pass, and certain dependent passes. Malaysian Work Permit holders may sublet to Malaysians under the Malaysian Workers Subletting Scheme.
  • Non-citizen tourists and visitors on Short-Term Visit Passes — not permitted

Occupancy Cap

HDB imposes an occupancy cap of 6 persons per standard flat. This cap includes the flat owner, family members residing in the flat, and all tenants. Agents must confirm the total occupancy count is within this limit before advising the owner to take on additional tenants.

Registration Requirement

Room rental must be registered with HDB via the HDB Flat Portal within 7 days of the tenancy commencement. The owner must provide tenant details (name, NRIC/passport, pass type, tenancy period). Failure to register is a breach of HDB’s terms and conditions and can result in enforcement action.

Minimum Rental Period

The minimum rental period for HDB room rental is 6 months. Short-term rentals (under 6 months) are prohibited — this applies regardless of whether the arrangement is formalised with a tenancy agreement or not.

Whole-Flat Subletting Rules

Subletting the entire flat — where the owner moves out — requires the flat to have completed its MOP and requires HDB approval before commencement:

MOP Requirement

The flat must have fulfilled its Minimum Occupation Period (5 years from key collection for most flats). Flats purchased under the Prime Location Public Housing (PLH) model have a 10-year MOP for whole-flat subletting. Agents must confirm the MOP status before advising on whole-flat rental.

HDB Approval Process

Owners must apply to HDB for approval to sublet the whole flat before the tenancy begins. HDB considers the owner’s reason for subletting (typically the owner must have alternative accommodation during the subletting period). Approval is granted for a defined subletting period and must be renewed if the owner wishes to continue subletting.

Subletting Period and Renewal

HDB approval for whole-flat subletting is granted for up to 3 years at a time. Owners must apply for renewal through the HDB Flat Portal. If the subletting period expires without renewal and the flat continues to be sublet, the owner is in breach of HDB’s terms.

Tenant Eligibility for Whole-Flat Subletting

Tenant eligibility rules for whole-flat subletting are similar to room rental but the 6-person occupancy cap still applies. Non-citizens must hold eligible passes — tourists and short-term visitors are not permitted as tenants.

Minimum Rental Period

The minimum rental period for whole-flat subletting is also 6 months. Short-term whole-flat rental is prohibited under HDB’s terms and constitutes a serious breach that can result in HDB compulsory acquisition of the flat in the most severe cases.

Agent Obligations

CEA agents facilitating HDB rental transactions must:

  • Confirm MOP status before marketing a flat for whole-flat subletting. Listing a flat for whole-flat rental before MOP is complete is a misrepresentation to prospective tenants.
  • Verify tenant eligibility for the specific flat type and subletting arrangement. Assisting an owner in placing an ineligible tenant exposes the agent to disciplinary action.
  • Advise on registration requirements — the owner is responsible for registering the tenancy with HDB, but agents should brief their landlord clients on this obligation.
  • Not facilitate short-term rentals. Knowingly assisting a landlord to use an HDB flat for short-term rental (Airbnb or similar) is a serious regulatory breach for both the owner and the agent.

Agent note: HDB conducts periodic audits of sublet registrations and investigates complaints about unauthorised subletting. An agent who facilitates a non-compliant HDB rental arrangement may face CEA disciplinary proceedings in addition to any action against the flat owner.
