Employment Pass, S Pass, and other work pass holders can buy private residential property in Singapore — but they pay 60% ABSD as foreigners. Singapore PRs pay 5% ABSD on a first property. HDB flats are off-limits to foreigners regardless of work pass status. What CEA agents must advise EP and work pass clients on before they commit to a purchase.

Who Is a "Foreigner" for Property Purchase Purposes?

Under the Residential Property Act (RPA) and ABSD framework, a foreigner is any individual who is not a Singapore Citizen (SC) or Singapore Permanent Resident (SPR). This includes:

  • Employment Pass (EP) holders
  • S Pass holders
  • Dependent Pass (DP) holders
  • Long-Term Visit Pass (LTVP) holders
  • Student Pass holders
  • Any other non-resident foreign nationals

Work pass status does not grant SPR status or any reduction in ABSD. An EP holder who has lived in Singapore for 20 years is still a foreigner for ABSD and RPA purposes unless they have been granted SPR or SC.

What Property Can Work Pass Holders Buy?

Private Residential Property (Condominiums, Apartments)

Foreigners (including all work pass holders) can freely purchase private residential property in Singapore — condominiums, apartments, and flats in non-landed strata developments — without requiring government approval. No restriction on ownership, no cap on number of units.

Landed Residential Property

Foreigners are generally prohibited from purchasing landed residential property (detached houses, semi-detached, terrace houses) under the Residential Property Act. The exception is Sentosa Cove, where foreigners may purchase landed property with Singapore Land Authority (SLA) approval.

Approval for landed purchases outside Sentosa Cove is almost never granted for work pass holders — these are typically reserved for individuals who have made exceptional economic contributions to Singapore.

HDB Flats

HDB flats — both BTO and resale — are completely off-limits to foreigners. Work pass holders cannot purchase HDB flats, cannot be listed as co-owners of HDB flats, and cannot be essential occupiers of a flat purchased under SC/SPR schemes that require the occupier to be SC/SPR.

Executive Condominiums (ECs)

During the initial restricted period (before the 5-year MOP from TOP), ECs are subject to the same eligibility rules as HDB flats — foreigners cannot purchase them. After full privatisation (10 years from TOP), ECs are treated as private property and foreigners may purchase them, subject to the 60% ABSD.

ABSD Rates for Foreigners (2026)

Following the April 2023 ABSD revision, foreigners pay 60% ABSD on any residential property purchase, regardless of how many properties they own. There is no tiered rate for foreigners — the rate is flat.

BSD for Work Pass Holders

Buyer's Stamp Duty (BSD) applies to all purchasers at the same progressive rates regardless of citizenship:

  • First S$180,000: 1%
  • Next S$180,000: 2%
  • Next S$640,000: 3%
  • Next S$500,000: 4%
  • Next S$1,500,000: 5%
  • Remainder above S$3,000,000: 6%

Financing: LTV and TDSR for Foreigners

Work pass holders are eligible for bank mortgages in Singapore, subject to the same regulatory limits as citizens and PRs:

  • LTV limit: Up to 75% of purchase price or valuation (whichever is lower) for a first housing loan — same as SC/SPR
  • TDSR: 55% of gross monthly income — same threshold as SC/SPR
  • HDB loan: Not available — HDB concessionary loans are only for HDB flat purchases, which foreigners cannot make

In practice, banks assess foreign income with additional scrutiny. Variable components (bonuses, commission) may be haircut more aggressively. Work permit holders with shorter remaining EP validity may face reduced LTV offers from some banks.

CPF Usage

CPF cannot be used by work pass holders who are not Singapore Citizens or PRs. There is no CPF contribution for most work pass categories. Even if a foreigner has CPF savings (e.g., from a prior employment period while on a different pass), CPF usage for property purchase is generally restricted to SC and SPR.

Key Practical Points for Agents

When advising EP or work pass clients:

  1. Confirm ABSD upfront — 60% ABSD is a major financial commitment. Confirm the client is aware before proceeding to property viewings
  2. Check if SPR application is pending — a client who receives SPR before exercising the OTP pays 5% instead of 60%. The status at the time of OTP exercise (signing, not issuance of OTP) is what determines the rate
  3. Financing — advise the client to obtain an In-Principle Approval (IPA) from a bank early; foreign income documentation requirements are more demanding
  4. Remittance of funds — many EP holders purchase with offshore funds; advise on AML documentation requirements banks will request
  5. No CPF, no HDB loan — ensure the client understands the full cash requirement including 25% downpayment (if LTV is 75%) plus ABSD plus BSD

Frequently Asked Questions

Q: Can an EP holder and a Singapore Citizen purchase a property together?

A: Yes, but the ABSD is computed based on the profile of the buyer attracting the highest rate. A mixed SC/foreigner couple purchasing jointly would be assessed at the foreigner rate of 60% on the full purchase price. The remission for SC/SPR married couples does not apply where one party is a foreigner (non-SPR). Agents must flag this — the SC half of the couple should not assume the SC rate applies.

Q: If an EP holder becomes a PR, can they claim ABSD remission on a property already purchased?

A: No. ABSD is assessed at the time of OTP exercise. There is no ABSD remission or refund for status changes after the transaction is completed. The only scenario where status change helps is if the SPR/SC status is granted before the OTP is exercised.

Q: Can a foreigner rent a HDB flat?

A: Yes. Foreigners can rent HDB flats from HDB flat owners, subject to HDB's approval and subletting rules. Owning and renting are separate questions — foreigners cannot own HDB flats, but they can be tenants.

Q: Does the 60% ABSD apply to commercial or industrial property?

A: No. ABSD applies only to residential property. Foreigners face no ABSD on commercial (shophouses, office units) or industrial (B1/B2) property purchases. BSD still applies at the non-residential rates.

Q: Can an EP holder purchase a property and list it as a company address?

A: The use of a property as a business address is separate from residential purchase eligibility and ABSD. An EP holder can purchase a private condo and use it as a personal address. Using a residential property as a registered business address is a separate matter governed by URA planning rules and company registration requirements.
