Overview

When a Singapore Citizen (SC) marries a foreign spouse who is neither a Singapore Citizen nor a Singapore Permanent Resident (SPR), they form a mixed-status household that does not qualify under the standard HDB Public Scheme (which requires at least one SC and one co-applicant who is SC or SPR). The Non-Citizen Spouse Scheme (NCSS) is the HDB pathway that allows this household to purchase an HDB resale flat together.

The NCSS is available for HDB resale flats only — non-citizen spouses cannot be listed as co-applicants on a BTO application.

Eligibility Conditions

To qualify under the Non-Citizen Spouse Scheme, the following conditions must be met:

  • Main applicant: Must be a Singapore Citizen
  • Co-applicant (non-citizen spouse): Must be legally married to the SC applicant. The marriage must be registered and valid under Singapore law. The non-citizen spouse must hold a valid Long-Term Visit Pass (LTVP), LTVP+, or be on any other valid stay status in Singapore — they do not need to be an SPR.
  • Children: Children from the marriage (regardless of citizenship) can be listed as occupiers. Having SC children strengthens the household’s ties but is not a prerequisite.
  • First-timer status: The SC applicant must be a first-timer (not previously owned or occupied a subsidised HDB flat as an owner) to qualify for first-timer benefits, including CPF Housing Grants. Second-timer conditions apply if the SC has previously sold an HDB flat.
  • Income ceiling: The combined household income (including the non-citizen spouse’s income) must not exceed the applicable HDB income ceiling for grant eligibility purposes. For resale flat eligibility itself (not grants), there is no income ceiling for resale purchases.
  • Property ownership: Standard private property divestment rules apply — neither spouse should currently own private property or have disposed of private property within 30 months of the HDB application.

Flat Type Restrictions

Under the Non-Citizen Spouse Scheme, the household may purchase any eligible flat type (2-room to 5-room, executive flat) subject to standard eligibility conditions. There is no restriction to smaller flat types simply because the co-applicant is a non-citizen — this distinguishes NCSS from the Single Singapore Citizen Scheme (which restricts singles to 2-room flexi).

Resale Restrictions and Conditions

Flats purchased under the Non-Citizen Spouse Scheme are subject to specific resale restrictions that agents must explain clearly to clients:

Essential Occupier Restriction

The non-citizen spouse is listed as an essential occupier on the flat, not as a co-owner. This distinction is important:

  • The non-citizen spouse has no legal ownership stake in the flat — only the SC is the registered owner
  • The non-citizen spouse cannot be removed from the flat application during the MOP without HDB’s approval, and such removal may affect the flat’s eligibility conditions
  • If the marriage ends (divorce or death of the SC owner), the non-citizen spouse has no ownership rights to the flat — the flat belongs to the SC owner’s estate

MOP and Resale Conditions

  • The flat is subject to the standard 5-year MOP from key collection date before it can be sold on the open market
  • During the MOP, the flat cannot be sublet in its entirety (room subletting rules apply)
  • At the time of resale (after MOP), the SC owner is free to sell to any eligible buyer — there is no restriction on who can buy the flat at resale, and the flat has the same market liquidity as any other HDB resale flat

CPF Grants for Non-Citizen Spouse Households

First-timer SC applicants under NCSS may be eligible for certain CPF Housing Grants, but grant eligibility is affected by the non-citizen co-applicant:

  • Enhanced Housing Grant (EHG): May be available to the SC applicant (as a first-timer) subject to household income ceiling ($9,000 per month for families). The non-citizen spouse’s income is included in the household income calculation.
  • Family Grant / CPF Housing Grant: The SC applicant may be eligible for the Family Grant (typically $40,000–$50,000 for eligible first-timer SC with SC/SPR co-applicant). Whether the non-citizen spouse qualifies the SC for the full Family Grant rate — or a reduced rate — depends on HDB’s current grant framework. Agents must check current HDB grant eligibility with HDB directly, as grant conditions for non-citizen household members are subject to change.
  • Proximity Housing Grant (PHG): May be available if the couple purchases near the SC applicant’s parents (conditions apply).

Agent note: Grant amounts for NCSS households depend heavily on the current HDB framework. Always direct the client to obtain a current HDB Flat Eligibility (HFE) letter, which confirms the specific grants applicable to their household. Do not quote grant amounts without the HFE letter — grant rates can change between exercises.

ABSD Implications

ABSD on HDB resale flat purchases is relatively straightforward for SC buyers — Singapore Citizens purchasing their first residential property pay 0% ABSD. If the SC applicant is purchasing a second or subsequent property, standard SC ABSD rates apply.

The non-citizen spouse’s status can affect ABSD if the couple jointly owns private property. For the HDB resale flat purchase specifically, since the non-citizen spouse is an essential occupier (not an owner), the ABSD is assessed only on the SC owner’s profile.

Path to PR and Upgrading

If the non-citizen spouse subsequently obtains SPR status during or after the MOP, the household’s options for future HDB purchases or private property expand. Agents should be aware of these potential lifecycle transitions when advising NCSS households:

  • After MOP, the SC owner can sell the resale flat and, if both spouses are SC by then, re-enter the HDB market with standard Public Scheme eligibility
  • Private property purchase is available to the SC owner at any time (subject to ABSD on second property) — the non-citizen spouse may not hold private property while the HDB flat is owned, unless HDB’s conditions are met
